Internet Libel Law Passed In The Philippines

Well, hello there everyone. Another Facebook memory popped up on my feed and this happened sometime in November 2013 when the killer typhoon "Yolanda" hit the Philippines.

Good afternoon. Let's go back to what I was saying - The Internet Libel Law In The Philippines. I am not into political topics and not so genius about the laws and stuff. However, since most of us here on read.cash are working from home, you know what's up.

If you live in the Philippines, you know all about this and probably have a strong feeling either for it or against it. I have seen both opinions, but on the news as well as in Philippine news Facebook Pages I follow, I have seen "almost all" people being against it. Politicians really are the ones who benefit the most from this law in the Philippines because nobody is the center of negative attention and publicity more than them. It is all you see on TV, "scandal" is the most common term I see plastered everywhere.

Now, the publishers of the articles such as News, Magazines, and Social Media like Facebook do tend to handle things more in a manner of reporting and less like opinion and judgment. The real people who are at risk are the private citizens, the angry voters, the cheated by the years of bad governance. When they see these articles they speak up, and they speak up "loud", in the "thousands".

As you know if I tell you something in person, maybe only 4 people will hear about it, but if I say something on the internet then thousands hear about it. Does that make sense?

For Example, Typhoon Yolanda that I have mentioned above - not only did the destructive weather make news, but (I won't name names) politicians were photographed and named for doing things like plastering their faces on relief goods for election purposes causing people to wait for relief. Other politicians (I won't name names) took over a week to even go to Tacloban and devastated areas while other countries offering assistance got there first.

So what does a libel law like this do? It hides the truth!

Libel is defined as defamation by written or printed words, pictures, or in any form other than by spoken words or gestures. Anyone can claim libel and take you to court, especially in the Philippines and it only costs between Php 1,000 pesos and Php 2,500 pesos to file an affidavit of complaint against someone which is nothing to a politician.

Here is where the problem comes in.

The politicians have the money, not the people. Where are court proceedings? I'm guessing they would be in Manila (the main office - correct me if I'm wrong).

Take me for example:

I am about 8 hours north of Manila and if I am subpoenaed to court, I would have to travel 8 hours, pay to stay somewhere for more than one day likely, I would lose time from my daily home-based work and it is possible that I may not even be able to pay to appear or defend myself.

What happens now? Without being able to defend myself, (even if not guilty) I would be arrested. Wow! Getting the picture? Censorship by the government to hide its flaws is looking strikingly similar to what the Communist China government does, isn't it?

Be careful, bloggers. You better watch out. You better not cry!

yikes. the Philippines laws are nothing to laugh at. Before this post, i had an obviously erroneous picture of the Philippines and it's people.

After reading this and having questions, i read up and now have a more accurate picture based more on fact.

My picture, embarrassingly and probably racist i am ashamed to admit, was based upon the assumption that because the Philippines has had such a long history with the United States their laws and government would be much more inspired by or based on the US ones.

I am ashamed to find to have held such thoughts based on such reasoning, as well as shocked. I want to offer my apologies to the Philippines and Filipino everywhere.

These types of laws basically seek to censor. Here in Venezuela, the government enacted a law against hatred. And who are imprisoned or accused? Citizens who express their opinions or complaints on the networks against government officials. So most choose to keep a low profile. Have a great day, amiga, when you read this!

Well yeah, we are currently having almost the same experience here in Nigeria, we have no liberal access to twitter 😬 because apparently people use twitter to defame the government 🙄 which is a criminal offence, you can spend time in prison for it .

Ang kulang sa mga pinoy ay ang education about their rights, may it be constitutional, statutory, etc. We won't know how to defend ourselves if we don't know our rights. We have freedom of expression but it doesn't mean we can just say anything that we want. Ang kaakibat nyan ay responsibilidad sa tama at totoong pamamahayag. It is the right to write and speak what is right :)

Politics and politicians are toxic these days either in your country or mine. They don't even bother us after winning the election. And post one thing against them and see his people beating you somewhere 🤣 I experienced it once tho 7 years ago. I was enthusiastic supporter and Posted something against the other one. I was beaten by his gangsters and guess what? The person I supported went to others after winning and they became one unit. Lol I never supported anyone after that.

pag kinasuhan ba ako ng libel.. and then I counter the same so we go around in circles pointing a finger at who libeled who.. as crazy funny as that would sound I'd probably lose because they have the advantage of being in a position and I am not..

Hello, I agree with you, that law only benefits the politicians, not the common citizen. Politicians in the Philippines seem to be the same as in the rest of the world. With typhoon Yolanda they only appear for a publicity photo. Just like here. I don't have to go to the communist government of China to imagine how it would be, because here in my country, Venezuela, it is like that. The government here always hides the truth, I imagine that if they implemented that defamation law in Venezuela the queue of citizens paying fines, for everything they say about the government, would be more ruin for the people. I really can relate with the issue you raised. Because here in Nigeria and even in most African countries its one of the things we face. There are restrictions on what we post online even to the point of Twitter ban.

It was a really sensitive issue being discussed in this article, which many wouldn't understand unless they actually calm down and read it properly like every reader should do. Speaking of politicians keeping reliefs till election period, it's something that happens almost everywhere, especially in Africa, and I don't think anything can be done about it.
