Mythbusting (Americans only): “Every Crypto Transaction is a taxable Event”

Many of us have heard this phrase or similar!

Is Every Crypto transaction really a taxable event?

If most transactions are taxable, yes this could dampen Peer-to-Peer Cash (P2PCash) adoption. I KNOW this is NOT true for me and the vast majority of transactions by other Americans since I have researched what the law actually says (USA only). But the generations of propaganda from the authorities and dino-media have been very successful in getting many to fear the IRS when in fact the "income-tax" does not even apply to the VAST majority of Americans!

The "income-tax" (USA only) ONLY APPLIES to:

  • Non-resident aliens with U.S. source income

  • Foreign corporations with U.S. source income

  • U.S. citizens abroad with foreign earned income

There, I said it! Bold statements of fact require strong evidence and there is a plethora of evidence! Since I am all about ADOPTION of P2PCash, I want as many to read this as possible. So today I will just present one item of evidence that the "income-tax" does NOT apply to the vast majority of Americans!

How Does the Law Define a "Withholding Agent"?

withholding agent as defined in 26 USC §7701(a)(16)

Nice and short, but we now have to see whom a withholding agent deals with per sections 1441, 1442, 1443 and 1461.

The title of section 1441 is: Withholding of tax on nonresident aliens

Well I know that's not me since I am NOT a non-resident alien, are you?

The title of section 1442 is: Withholding of tax on foreign corporations

I am also NOT a foreign corporation, what about you?

The title of section 1443 is: Foreign tax-exempt organizations

Strike three! I am NOT a foreign tax-exempt organization either, are you?

And finally, section 1461 where a withholding agent is made liable for such tax (to be collected from entities defined in 1441-1443).

So we see that a withholding agent is ONLY required to deduct and withhold any tax from:

  • non-resident aliens

  • foreign corporations

  • foreign tax-exempt organizations

Its clear to me that I am NOT any of those things!

The headline ought to rather be

For U.S. citizens, every Crypto Transaction is a taxable Event"

since a more general headline appears unsuitable for an article which deals exclusively with the situation of the U.S. taxpayers.

Certainly U.S. income tax law doesn't generally apply to everyone on the globe, and there are countries in which crypto transactions are not taxable events under some/all circumstances. Putting forth that evidence alone would be sufficient to bust the general myth set out in the current headline, but it seems your article tries to in fact address the question of

"Do U.S. citizens owe income tax at all"?

Neither am I, and I am not going to try to fact check your article's thesis against the U.S. tax code, jurisprudence or legal precedent.

Consequently I do not wish my comments to be construed as endorsement of the correctness of that central thesis, even if my personal sympathies may align with "there is something here to be investigated deeply" (by U.S. citizens).

I do however, welcome any feedback from people who are better informed on the legal situation of U.S. citizens addressed above.

RE wallet issue... I have worked around to solve the problem (not ideal) and have contacted read.cash with some info on my usage situation. Hopefully, a permanent solution can be found! I expect read.cash has been running ragged with all the updates etc... in such a short time since its original release and congratulate them!

RE mythbusting article deviation... I understand, and expected this type of response to such a different premise than most have been socialized (in USA anyway) to believe.

Challenge to you/anyone here, I have a few extra copies of Dave Champions book. I am willing (at my discretion) to send one to someone that will commit to read, review and report on their findings. I'll likely give much more weight to someone I "know"/have read about etc... in terms of their reputation etc (or whom they wish to review the book if they don't feel "qualified")... And that when they are done with the book, to pass it on to some other interested person.

My goal/hope is get P2PCash past the tipping point on the way to mass adoption. If through the process many find their way (USA) out of the scam of the way the "income-tax" is being applied, then so much the better!
