Ethics

They are orders and prohibitions set by one's own conscience that regulate one's own behavior and are sanctioned with remorse. For example, being shamed by society , being ostracized, not wanting everyone's well-being.

According to this definition, there are the following four characteristics of the code of ethics;

1- The rules of morality also contain orders and prohibitions, such as the rules of law and religion, in essence.

For example, " help the elderly ", " give pregnant women a place on the bus ", etc.

From this point of view, there is no difference between the rules of law and the rules of decency. Both types of rules have the property of normativity.

2- The rules of morality, like the rules of law, are aimed at regulating human behavior.

3- The legislator of the moral code is a person's own conscience. In other words, the interlocutor and the legislator of the moral code are the same person.

4- The sanction of the moral code is the punishment of conscience.

Let us explain these features of the rules of morality on an example ;

Suppose student A is sitting on a seat on a municipal bus.

An elderly, barely standing man got on the bus. Student A, who saw this man, immediately got up in accordance with the voice coming from inside and gave his place to this person. There is an application of a code of ethics here.

In contrast, student B, who was in the same situation, did not actually want to give the old man a place, but gave him his place because he was afraid of the embarrassing looks of the people on the bus.

In this example, there is an application of the rule of custom and menstruation, not the rule of morality. Because here, student B was replaced by the old man, not by the voice coming from within, but by the shameful looks of the surrounding people.

Student C, who is in the same situation and does not face the effects of the environment, has not given his place to the old man. The old man was standing next to student C's chair and looked at student C with pleading looks. An elderly man standing on the road got sick and had a heart attack and died at the bottom of student C's seat on the bus.

The remorse felt by student C, who experienced this incident, is an excuse to comply with the code of ethics. Student C, who faced this institution, has always given his place to the elderly again.

The Law - Morality relationship : There is usually an overlap between the rules of law and the rules of decency. Mostly, law also commands what morality commands.

For example, the fact that spouses remain faithful to each other is an order of both morality and law. But it cannot be said that morality binds everything that it commands to the law, to the sanction. For example, "help the elderly" is a code of ethics, but in general it is not a rule of law. In this sense, it is sometimes said that law is a " minimum morality ". But there is no complete overlap between law and decency. There are a lot of rules of law that are unrelated to morality.

Usually, the rules of procedural law ( for example, the fact that the criminal court consists of three doctors, the time for filing a lawsuit in an administrative jurisdiction is 60 days) have nothing to do with morality.

Customs and menstrual rules

Customary rules are orders and prohibitions established by a certain social environment in which a person is located, which regulate human behavior and can have very different sanctions, such as warning, condemnation, exclusion, lynching.

According to this definition, the rules of customs and menstruation have the following four characteristics;

1- the rules of customs and customs also contain orders and prohibitions, such as the rules of law, religion and morality, in essence.

For example, " say hello to people you meet indoors ", " visit relatives on holidays", "keep your honor", " kill your father's killer (don't let your father's blood stay on the floor)", etc. From this point of view, there is no difference between the rules of law and the rules of decency and menstruation. Both types of rules are normative in nature.

2- customs and menstrual rules are also intended to regulate human behavior, such as the rules of law.

3- the legislator of the rules of customs and menstruation is a certain social circle.

4- the sanction of customs and menstrual rules occurs in various ways such as shame, condemnation, exclusion, tattooing and even killing (lynching). Customs and menstrual rules as of these sanctions ;

1- teams

2- pieces

3- they can be divided into three categories, namely customs.

Rules: These are the rules of custom and menstruation, which have mild sanctions such as shame, condemnation if they are violated.

Customs: These are the customs and menstrual rules that have moderate sanctions such as exclusion, expulsion from the group if they are violated.

Customs: these are the rules that damage a person's own integrity if they are violated. Deathly.

Law - custom and menstrual relationship: there is sometimes an overlap and sometimes a conflict between law and dec and menstruation.

In some cases, the same code of conduct can be ordered by both custom and custom, and by law. In fact, law sometimes refers to the rules of custom and menstruation, and in this case, custom and menstruation can become the source of law.

However, sometimes customs and customs may conflict with the law. The law has strongly prohibited the code of conduct ordered by custom and custom.

For example, " feud " is a custom and menstrual rule. But our law prohibits this and punishes it most severely.

Comparison between the rules of social decency :

1- For one thing, all of these rules are normative in nature. That is, all of them command or forbid something.

2- What all of these rules order or prohibit is a human behavior.

3- the legislators of the rules of law are the authorized bodies of the state. The rules of morality are set by a person's own conscience. The legislators of customs and menstrual rules are people in a certain social environment.

4- all rules of social behavior have been sanctioned.

The common function of the rules of social order: These rules are complementary to each other.
