Constitution
The Constitution is the whole set of rules of law that occupy the highest place in the hierarchy of norms and are established and amended in a different and more difficult procedure than the law.
Constitutional rules :
- regulates the establishment, functioning of the basic organs of the state ( legislative, executive, judicial ) and the basic rights and freedoms of citizens in the face of the state.
- New constitutions were made in Turkey in 1876, 1921, 1924, 1961 and 1982. The constitution in force today is the constitution of the Republic of Turkey dated November 7, 1982 and numbered 2709.
- Constitutions are made by a power that arises in extraordinary circumstances, such as a revolution, a government coup, a war, and is unlimited.
- Once constitutions are made, they change them according to the procedure determined by themselves.
- The power to amend the Constitution is called the secondary constituent power.
- According to the 1982 Turkish constitution, the authority to amend the constitution belongs to the Parliament.
- Article 175 of our Constitution. According to its article, the proposal to amend the Constitution must be submitted in writing by at least one third of the total number of members of the Parliament.
- The proposal to amend the Constitution is discussed twice in the Parliament.

- the vote on the adoption of the proposal to amend the constitution is held by secret ballot.
- In order for the amendment proposal to be accepted, the proposal must be accepted by at least three-fifths of the total number of the Parliament 3/5.
- If the amendment proposal has been accepted by more than three-fifths of the total number of members of the Parliament but less than two-thirds of the vote ;
- The President submits this amendment to the people's vote within fifteen days or sends it back to the Parliament for consideration once again.
- The proposal for amendments sent back to the Parliament is accepted by a majority of at least three-fifths or two-thirds of the total number of members.
- if the proposal for a constitutional amendment has been adopted by a three-fifths majority, the President must submit the amendment to the popular vote. However, if this amendment has been adopted by a two-thirds majority, the President may approve this amendment within fifteen days or submit it to a popular vote.
