The constitution and the laws are like God in a sovereign nation.

The citizens of a nation have a constitution and the laws. The judicial system works in different parts of the country under the guidance of well-instituted laws.

  • A central court, generally called the supreme court, is the ultimate platform in a democratic nation to deliver justice to its citizens.

There remain other lower courts and high courts in the states besides special courts to look after financial frauds and different consumer irregularities.


India has its judicial system network in every corner.

  • Every state has high courts, and the states have many lower courts at the district and sub-division levels.

The high court remains the highest authority in the states, whereas the supreme court in the capital city New Delhi remains the ultimate authority of all the country's courts.

  • If someone fails/loses a court case in a district-level lower court, they may appeal it in the immediate higher court and finally to the state's high court.

  • If a legal suit doesn't go in favor, the party can appeal to the supreme court.

But. if someone fails in a legal battle in the supreme court, the case ends there because the supreme court is the highest authority of the Indian judicial system.


The government may also go to court!

India's states and central government may also go to court challenging citizens' legal suits or public interest litigations.

  • For example, in recent years, it has been observed that several irregularities and corruption charges against the government of the state of West Bengal went to the supreme court when they lost cases in the Kolkata high court.

In most lost cases in the Kolkata high court, the state government appointed the most highly paid advocate to plead for them in the supreme court.

  • These famous (or infamous) supreme court advocates charge daily fees of INR five million or more for a single appearance!

  • Interestingly, in many cases, these highly paid supreme court advocates could get the state government interim stay orders from the supreme court on the orders of the Kolkata high court!

Astonishingly, all these stay orders were obtained within a matter of a few days, whereas many important cases in the supreme court have been pending for months and years!


What are the roles the supreme court play in India?

If the common citizens of India ask a simple question, what roles does the supreme court of India play?

  • Is it a court with supreme power to overrule the orders of the state high courts?

  • Is it a court to give interim relief to the corrupt state governments and criminals?

  • Is it a court to legalize unregulated governance by the states to the citizens?

The common mass in India is confused with the functioning of the judiciary.


The supreme court of India removed Kolkata high court justice from hearing a corruption case due to appearing in a TV interview!

Read news detailing how a Kolkata High Court justice Abhijit Gangopadhyay has been removed by the bench of chief justice of the Supreme Court, Justice D. Y. Chandrachud of India, from hearing a corruption case against the government of West Bengal.

A complaint has been submitted against the Chief Justice of the Indian Supreme Court, D. Y. Chandrachud, alleging he discussed LGBTQ in a press interview.

How can the Chief Justice give justice for a case about same-sex marriage which is on his bench?

It's human system still, we have a highest court up there that listens and balance things that the physical can't do. I wonder why do they van the Kolkata while they can appear on TV interview for other cases.

The common mass can't afford the VERY HIGH fees of an advocate of the Indian supreme court. Only the rich and the criminals can afford to do it. Even if someone manages to depute an advocate, getting a date from the supreme court is very difficult. It takes weeks and months to get the legal case rolling. But a parliament member, a minister, a wealthy business owner, or a criminal can get the date of hearing and cases verdict within a couple of days!

A question arises. For whom does the supreme court of India exist?
