Two women arrived at the court of Qazi Ibn Abi Laila, a well-known judge of their time.

One day, my uncle came to my house and asked my husband to marry his daughter." I offered a second marriage with the condition that the first wife (ie I) hand over the matter to my aunt. My husband accepted the condition in the marriage cycle with a virgin girl. My husband got married for the second time on the honeymoon. She came to me and said to me: I have married my daughter to your husband. Your husband has left your case in my hands. I will divorce you while advocating for your husband.

Judge, I am divorced.

Some time later, my uncle's husband arrived tired from the journey. He was a poet and a beautician. I sat down in front of him and asked him, "Will you marry me?" His happiness was gone. He immediately said yes. I made a condition in front of him that you hand over the case of your first wife (ie my aunt) to me. This is what he did. I exercised my right to advocate. Divorced and married to her aunt's ex-husband.

Qazi Ibn Abi Laila sat down holding his head and then asked:

My aunt said:

Qazi Sahib, isn't it haraam that this girl of both me and my daughter has got divorced and then my husband and my daughter's husband also took her away.

Qazi Ibn Abi Laila said:

I did not find anything haraam in this case. Divorce is also permissible, advocacy is also permissible. After divorce, the wife can go back to her ex-husband, provided that in the meantime she marries someone else and divorces or her husband dies. The same thing has happened in the story.

After that the Qazi narrated this incident to Khalifa Mansoor. Khalifa laughed and said that whoever digs a pit for his brother will fall into this pit himself. He grew up and fell into the deep sea instead of the pit.
