Assault is the act of putting a person in fear of bodily harm Assault is any act that put a person in fear of violence or in fear that battery is about to be committed against him. In other words assault is threatening to harm or apply force to another person with the present ability to carry out the threat. Examples of assault:Threatening a person with knife, broken bottle,pointing a gun at someone without shooting,advancing towards a person and shaking your fist and threatening to beat him up .They are two elements of assault which the plaintiff has to prove to succeed in a claim for assault. 1 That there was a threat to apply force 2 That the act will put a reasonable person in fear of battery. Assault is a breach of ones fundamental human right as is contained in sec 34(a) of the 1999 constitution which says that " no person shall be subjected to torture or to inhuman or degrading treatment.
