What is copyright and why, the provisions of copyright law ?...

Copyright:

Copyright is the term that is closely associated with the protection and management of intellectual property. The underlying meaning is hidden in the English word copyright. If we analyze the meaning of the word Copy and Right separately, then the meaning will be the right to copy.That is, all kinds of creative work, such as literature, works of art, music, films, software, etc., without the permission of the creator or author, copy, reproduce, translate, adapt or copyright ideas, international law and treaty, domestic law, ethics and positive perception.

What is piracy and its evils: The word piracy is widely known nowadays. It literally means "infringement of copyright". But in today's world, the word piracy has many meanings. As a result, piracy now does not simply mean copyright infringement. Piracy is the reproduction of any unauthorized creation. Currently, almost all of the textbook, film, music and computer software markets are trapped in the visible and invisible black net of pirates.Many educated people also do not understand the difference between real imitation. Many supportive people and their children are handing out pirated books. But our engineering and medical science students are being deceived again and again by reading pirated copies instead of colorful foreign books. Deprived of Global Knowledge. He is lagging behind in the competition for real knowledge. As technology advances,Especially in the development of computer technology, it is not always possible to understand exactly how the creation of cars is falling into the trap of theft. Especially in this age of internet, we are getting the elements or sources of many important cultural works at home. Due to piracy, the creator of the work is being deprived of royalty. The reader is being deprived of real knowledge and the government is losing revenue.

★★★ Copyright Concerns International Law and Convention:

As a member country of the World Intellectual Property Organization (WIPO), Bangladesh is a member of the Bern Convention, the UNESCO Universal Copyright Convention (UCC) and the World Trade Organization (WTO). Obliged.

1. According to Rule 2 (24) of the Copyright Act - "Maker" means -

★ a. Composer in the field of literature or drama.

★ b. Composer or composer in the field of music.

★ c. Producer for any artistic work other than photography.

★ d. Photographer in the case of photographs.

★e. Producer for film or sound recording.

★ f. In the case of computer-generated literature, drama, music, or artwork, the person or organization that created the work.

2. Copyright rights Section 17 of the Copyright Act deals with the imposition of copyright. The copyright holder of an existing work or a potential copyright holder of a future work may assign a copyright to any person for a full or partial term, provided that the copyright of the future work will take effect once the work exists.

3. Type of assignment:

According to Section 19 of the Copyright Act, the following conditions must be met for a work to be valid:

★ a. Must be signed by the authorizing agent or the appropriately authorized representative from him.

★ b. The copyright infringement of an action must identify the action and the rights to the assignment and the term of the assignment and the geographical extent of the assignment of the assignment must be specified in the document.

★ c. The copyright title deed of any deed shall specify the royalties payable and shall be subject to review, extension or cancellation of the copyright assignment in accordance with the mutually agreed upon.

★ d. In case the employer does not use the rights granted to him for one year from the date of assignment, the expiry of the said period shall be deemed to have lapsed.

★E. If there is no expiration date of the title deed or there is nothing different in the title deed, it will be deemed to have been done for the next five years from the date of title deed.

★ f. If the geographical scope of the assignment of rights is not mentioned, then its scope will be considered as the whole of Bangladesh

★ g. None of the provisions mentioned in sub-sections (b), (c), (d), (e), (f) shall apply to the assignment of rights executed before the enactment of this Act. (Article-19)

★★★4. Copyright expiration In the case of works other than photographs, the term of copyright in Bangladesh is up to 60 years during the life and death of the creator (Article 24). In case of photographs, the copyright period is 60 years (Article 26).

★★★ 5. Copyright Association According to the provisions of Section 41 of the Copyright Act 2000, a copyright association can be formed and registered. For this you have to apply to the Registrar for registration of the association in the prescribed form. The Registrar will submit the application to the Government. The Government shall register any association as a copyright association subject to certain conditions, taking into account the interests of the framers and owners of other rights under this Act, the public interest and the interests of the people, the qualifications of the applicant and professionalism. .

★★★6. Copyright registration For copyright registration, one has to apply to the Registrar of Copyright in the prescribed form along with the treasury invoice of the fee prescribed by the government, 2 copies of the work sample and other necessary documents. The Registrar includes the details of the action in the Registrar subject to necessary investigation. (Article 55)

★★★7. Provision of criminal remedy in civil There are provisions for redress in both civil and criminal cases of copyright infringement. There are provisions for sanctions, recovery of damages, etc. through civil courts and imprisonment-fines through criminal courts. (Articles 65-61)

★★★8. Punishment for copyright infringement There is a provision of imprisonment for up to five years and a fine of up to Rs two lakh for copyright infringement of film related works. There is a provision of imprisonment for up to four years and a fine of up to Rs. 50,000 (fifty thousand) for copyright infringement of any action other than film. (Article-72)

★★★9. Power of police to seize infringed copy If any police officer who is not below the rank of Sub-Inspector is satisfied that a crime of copyright infringement of any computer work under section-62 has been, is being or is likely to be committed, he should seize the plate used for making all copies of the work without an arrest warrant. And will similarly present all seized copies and plates to a magistrate as soon as possible.

★★★ 10. Appeal against the order of the Registrar Any person aggrieved by a final decision or order of the Registrar may appeal to the Copyright Board within three months of the issuance of that decision or order. (Article 95)

★★★11. Appeal against the order of the Board Any person aggrieved by any final decision or order of the Board other than any decision or order given in the appeal under section 95 may appeal to the High Court Division within three months of the issuance of that decision or order. (Article 96)

★★★ 12. Certain actions are not copyright infringement Reproduction of literature, drama, music and artwork for the purpose of reporting on judicial proceedings, personal study or personal use including research, reproduction by Parliament Secretariat for use only by Members of Parliament, reproduction for teaching process or examination by teacher or student, any amateur club or association or For the benefit of any religious, charitable or educational institution Reproduction of any literature, play, musical work performed, reproduction of any matter published in the Official Gazette except by law enacted by the Jatiya Sangsad, reproduction or publication of judgment or order issued by a court, tribunal or other judicial authority is considered copyright infringement. Will not (Article-72)
