Abstract

Pakistan is the second-largest Islamic state in the world. Islam has given equal rights to all. Through electronic and print media, we found that being an Islamic state; Still neglected by the transgender government and local Society. Many NGOs are working for human rights, but they have also ignored transgender. Most NGOs work for human rights, but they don't even care about transgender people. We have found that transgender people in Pakistan are ignored in every sphere of life, including education, government jobs, health care, and life security. In 2013, the Supreme Court of Pakistan conferred transgender rights that are still unenforceable in Society. Not just Society, but their families are not accepting them as family members. This review article's objectives were to review and highlight various aspects of issues faced by the transgender community of Pakistan. Every person living in the world is indeed treated as a human being regardless of whether male or female. Based on this, every person is entitled to enjoy all human rights such as the right to life, education, and dignity. But the reality is very different; There is also another sex in the world called hermaphrodite or third sex, according to research people who have both sexual organs, i.e., male and female in the same body. It is a harsh fact that, as third sex humans, face countless difficulties in surviving and being treated as human beings. In Pakistan, they are commonly known as Hijras, Khowajasara, and Murat.

Introduction

Who am I? This question shocked me. Why am I like this? Many countries have not yet verified my identity, and although I have not got the right to live my life on my will, I do not have a good position in government, and I am not yet accepted as a member of Society. Who am I? I am a transgender whom people call Khusra or Hijra in this community (Pakistan). I don't have any identity else than a dancer.  I am waiting for the day when the community will accept people like me as a member of Society, and I think there’s a long way down for it to be realized. 

Transgender, a person whose personal identity is not confirmed or is not the same as his birth identity, opposite from male or female gender. In South Asian countries, the concept of the third gender prevails, where members are referred to as neither male nor female. Pakistan is no different and has a vibrant culture of eunuchs. She is sometimes referred to as transgender in English-language publications. 

In 2013, the Supreme Court of Pakistan conferred transgender rights that are still unenforceable in Society. Not just Society, but their families are not accepting them as family members. The Islamic Republic of Pakistan and the Supreme Court have agreed that transgender people, like other citizens of this country, can be granted equal protection under Article 4 and 9 of the 1973 Constitution. In 2013, they got equal rights for all citizens of Pakistan. The federal and provincial governments gave them basic rights to work in various departments of governments, education, health, during comparable periods. Productive contradictions of transgender rights and Pakistani policing are quite inter-related.

Purpose and Objective

 

1. The purpose of this report is to create awareness among people of all societies.

2. It also aims at highlighting the role the transgender people may play in our Society, when being given their due rights.

3. Furthermore, the report is structured in a way that highlights the problems being faced by this very community and providing the mandatory recommendations to curb the discrimination, rigid attitude, and violation of rights of this community.

1) This report's objective is to imprint on the public the effect of prejudice against the transgender community.

2) Also, the realization of an individual's role in uplifting this community is a necessary element.

3) Moreover, by reasoning and evidence, the stance of wonders and changes this community can bring if given recognition is another major concern.

Background

In Pakistan, the case of transgender people came under fire when unknown militants shot one of the transgender persons. The administration was confused as to where to take the patient to the male ward or the woman as he was struggling with his death and lost his life.

Different aspects of Pakistani culture and themed transsexuals show very important roles in weddings, birthdays, Eid festivals and big events. Linking with transgender people in Pakistan (Murat, Hijrah, Khawaja Sara, and Khusra) This is a group of people with minimum rights or dignity in Pakistan. Because of uneducated and aggressive-minded people, they do not need to be identified as a person of Pakistani Society. They have faced "ignorance" and "big rejection" from all parts of Pakistan. According to a recent survey on transgender sexuality, nearly one-third of 50 children have chronic tendencies/opportunities. In other words, about 2% of the Pakistani population is transgender or affected (Akhtar, 2016). The third sex determines the family of the first child. At first glance, families become hyper about killing them or getting them out of their circle because they are ashamed and part of the family. Nobody knows which sex you are born from. Then the eunuch faced lower discrimination in families, communities, social groups, schools, and Society, and that means every step of life. Pakistan is the second-largest Islamic state in the world. We have found that transgender people in Pakistan are ignored in every sphere of life, including education, government jobs, health care, and life security. In most countries, transgender people (eunuchs) are sometimes the subjects of ridicule, abuse, violence, and persecution. Transgender (hijra) means being globally insecure, mainly because people have no awareness of gender diversity or non-gender binary existence. In Pakistan, particularly, the almost outright denial of the existence of transgender people (eunuchs) has resulted from their marginalization, as well as the lack of respect from Society at large. They face threats, harassment, and humiliation daily and are seen only as sex workers, dancers, or beggars. Since the independence of Pakistan, the transgender community has never been counted in a census. In the 2017 census, the first time the transgender community was counted and the number was 40,000- 50,000, although the Pakistan Supreme Court empowers the third gender in all official documents (Hyder, 2009). The Supreme Court of Pakistan ordered the survey of the third-generation population and gave them equal rights and have not received any information about the progress of this work in Pakistan.

Analysis

· The government gives the rights to the transgender community

Pakistan may seem like an unexpected place for transgender activism. The transgender community (called eunuch) in South Asia, an organized group of trans people, has long been a part of society and local culture. Over the years, trans genders (eunuchs) have been returned to a low-income group with few opportunities for employment or social advancement. In a landmark judgment in 2009, the Supreme Court of Pakistan recognized transgender people (eunuchs) as equal citizens. In 2010, the Supreme Court ordered full recognition of the transgender community (hijra), including free medical and educational facilities, microcredit schemes, and job quotas for transgender people. Transgender candidates could contest for the first time in the country's history in the second last general election. Earlier, Pakistan launched its first organization for educational and vocational training for the transgender community. The district administration has funded a four-month literacy program for transgender people in Okara. Nib Ali, a trans-person (eunuch) with a bachelor's degree, runs the project, which is overseen by the Punjab Literacy Department. Trans people (eunuchs) enroll in the program where they study English, mathematics, and science. Deputy Commissioner Saima Ahad appointed Anwar Bhatti as the coordinator of the literacy project. Trans people (eunuchs) are grateful to the government for that project. In 2017, the Lahore High Court ordered the government to include transgender people (eunuchs) in the national census. In February 2018, the Senate Committee decided that transgender people could inherit property without the need for their gender to be determined by the medical board. Parliament has passed the Transgender Persons (Protection of Rights) Act, 2018, which provides broad protections for transgender people. 

· The media give space to transgenders and issues of the transgender community. 

 

As Society becomes more aware of its issues and more people raise their voices against injustice, these issues are gradually being addressed. And television, as much as social media, has a big role to play. So, the Pakistani media is making the public aware of these things. 

In 2005, Ali Salim, 28, the son of an army colonel, is from Geo TV's Hum Sab Umeed, who appeared as cross-dressed Benazir Bhutto. Hence, Prem was his performance, which he has taken to acting to perform on-air and presents his talk show where he appears as a drag-up character named Begum Nawazish Ali. The BOL film was released in 2011. A daring film that has the guts to highlight issues are plaguing Society. It challenges the age-old customs and displays one reality most convincingly. The film revolves around the character of SAIFI, a transgender (eunuch) who is unapproved by her father and the difficulties that confront a transgender (eunuch) in real life. It paints the bitter reality of our Society. In November 2016, Pakistan's fashion industry allowed Kami Sid to work as a model. Kami Sid began his work in the fashion industry in Pakistan in 2016 as the first transgender (eunuch) model. Now there are many transgender (eunuch) models making it in the media industry, who are getting all kinds of work. Good and social change for everyone is beginning to accept these changes very positively.

The transgender (hijra) community is coming into the mainstream, and they have several allies to help them. Kami Sid was already a part of two documentaries How is Gay Pakistan? And highlight Chapun Chaupi what being transgender in Pakistan means. Express Entertainment has teamed up with the Talent Hub and Gold bridge Media Production House, Kami Sid, the first transgender model, and activist Dil E Nadan. The play revolves around a transgender woman and her relationships with Society. A hearty Kami whose name is innocent. "This is a human story that Kami and the community she lives in support her. It is great that Talent Hub is giving opportunities to all genders and all kinds of people. Pakistan's first transgender (eunuch) news anchor Marvia Malik has been hired by Kohenoor News, a local Pakistani television station. Owning an interview station, Junaid Ansari said that he kept only so because he was qualified."I have decided based on treating all human beings equally. I have yet to come to my mind about challenging social norms or breaking the taboo." She hired another transgender woman (hijra) at the outlet copy desk. Rimal Ali is a Pakistani transgender (eunuch) model, actress, and dancer. When she joined the fashion industry, she hid her identity because her transgender (impotent) penis became a barrier to her career. But when she was well-received, she said that she was indeed transgender. She has been in two Pakistani films. In the film Saat Din Muhabbat in which she has a leading role. Pakistani is allowing transgenders (eunuchs) to work in the media sector, which is a good move. 

· Some examples of successful transgenders

  

Kami Sid is a Pakistani trans person who has emerged as a fashion model. Sid is also an actor and LGBTQ (Lesbian, Gay, Bisexual, Transgender, and Queer or Questioning) rights activist. Sid was born into a middle-class family in Karachi with seven siblings. Sid's father passed away in her teens and was raised by a supportive mother. She holds a bachelor’s degree in Business Studies. She tried to go to the UK for higher studies but could not get a visa. In the trans communities of Pakistan, Kami Sid belongs to the ink community. Kami pointed out the importance of empowering transgender people as one of the productive members of Society. In 2012, Sid went to Thailand for his first photo shoot. Exposure turned out to be Pakistan's first trans model. In November 2016, Sid photoshoot against transgender (impotent) pages in Pakistan to neutralize Society's trans (UK) status. With this shoot, she has carved out a niche in the modeling industry and has become the first trance (eunuch) model of Pakistan. On the Pakistani Independence Day of 2017, Sid posed on a rooftop in Karachi while holding up a flag, was different in that regard. Being an activist, Sid was slowly gaining some kind of mainstream acclaim. She gives talks, is part of the panel discussion, and constantly advocates for equal treatment of transgender people. She said, "I am a human being like you and people. I want my Society to grow up and be accepted as equals, but most people have a very narrow mindedness. People like her will bring change in Society. People think we are sex workers, but we can be doctors". Kami Sid became Pakistan's first transgender model. Her first photo shoot was amazing. Pakistan's first trans model kaki Sid is fighting for visibility in Karachi. Transgender activist Kami Sid looks invincible in the new 'Rani' trailer. She gave a lecture on transphobia and misogyny at the Karachi Literary Festival in London. Sid is a board member of this non-profit organization called 'Street to School' that teaches sexual and cultural diversity to schoolchildren. She is the program coordinator for the AX International Minority Festival in Copenhagen. In 2017, Sid made her acting debut in a short film "Rani" as a transgender (eunuch) toy seller who sells goods on the streets. She also starred in the drama 'Dil-e-Nadan' based on the trans person (hijra) and their relationship with the community. Sid played the role, hoping it would help transform the image of the transgender community. Before that play, she was given television roles, but directors and producers were always wanted her to do dance and reinforce the stereotypical image of transgender people (hijra). That's why she didn't do them.

Nayab Ali

 

Nayab Ali, a member of the regional election committee of the Pakistan Election Commission, is an active part of the All Pakistan Transgender (Hijra) electoral network in Punjab. They have a master's degree. Nayab said that although her life was torn many times, she refused to give up and still had the motivation to serve her country and the people of her region. Nayab hoped to win the N-141 election as an independent candidate to help more people. She said she accepted this as a challenge and had already launched a social media campaign and would soon contact her teachers and community for help.

· First transgender (hijra) newscaster appears on Pakistani television.

 


 

"We can't do anything," Pakistan's first transgender (minister) news anchor says. A local Pakistani television station has hired Pakistan's first transgender news anchor. Marvia Malik, who has a bachelor's degree that includes teaching "the basics of journalism and citizenship," was hired the same day by an interview with the Kohenoor News a few months ago. He completed a training program at the station and hosted his first show."We can't do anything," Malik said in an interview. “We are educated, have degrees, but no opportunity, no encouragement. This is what I want to change. The way I created history in the fashion industry, I want to do the same in the media industry”. Earlier, Malik has done some modeling and recently walked the runway at a Lahore show in early March. The Kohenoor News has confirmed that Marvia Malik is the first transgender (broadcasting) news broadcaster in the country, and the station's owner said she was hired only because she qualified. In the interview, Marvia Malik addressed the widespread discrimination of transgender people in Pakistan, especially when it comes to employment discrimination and discrimination. Like other transgender (eunuch) people, I have to deal with my family, my own But there was no support. I did some menial jobs and continued studying. I always wanted to be a news anchor, and my dream came true when I got selected.

· Gender Guardian School, the first transgender school in Pakistan

        

Basic discrimination begins when we expel transgenders (eunuchs) from our schools and rid them of their basic right to education. The Experiment Housing Authority has opened Gender Guardian School in Lahore in collaboration with Exploring Future Foundation, an NGO. There are about 30,000 transgender individuals in Lahore. There is no age limit for people to enroll in a school, the school offers 12 years of academic education from the beginning to enrollment, and then to college. The school also offers technical courses such as fashion designing, beautician and hair-styling courses, graphic designing, computer, and mobile repair. The school initially trains transgender (hijra) people in eight fields. These include culinary, beauty expert courses, fashion design tailoring, and other skills-based courses. Upon completion of the training, funds and services will be provided to the transgender people (Hijra) to establish their Businesses, in the second phase, provide education to young transgender (hijra) individuals. The project aims to provide skills and education to this neglected section of the Society. This step will help bring the Society into the existence of transgender (eunuch) people and recognize their right to a decent life. Regular classes at the school started on April 23, 2018. According to the management, 15 faculty members have been hired, three of whom are from the transgender (eunuch) community. The school has an enrollment of 40 students. The school's founder Asif Shehzad said that two more schools would be set up in Islamabad and Karachi after the Lahore branch. A major milestone has been achieved in providing transgender (eunuch) their rights in the country through Pakistan's first transgender (eunuch) school. Transgender (eunuch) populations have always been discriminated against. 

· Another side of the reality 

 

When I was 11 years old, when my family found out about my gender, Rima said she was transgender. After some time, my parents did not live. My brothers did not accept me. Like other transgender people, I lived with a community of transgender people under the brutal "guru." Initially, when I approached my teacher and left my family, I could do nothing. My "teacher" had to learn to dance because it was the only way we could make money. If we refuse to dance, the "Guru" punished us very cruelly. It was very painful. We (eunuchs) are exploited by our teachers, who share our earnings with us and, in turn, 'protect' us.

He said that discrimination and humiliation affect us at all levels. It is even more painful when we are not given education and health facilities given to us in the legislature. It is sadder that when we go to government hospitals, they make fun of us and do not treat us like others. When I was a child, we couldn't get an education. Even now it is very difficult for people like me to get an education, lack of these facilities limits our opportunities to live a better life. This is all because our families did not make us their own. Then how and why Society gives us the opportunity and facilities to live a better life. We are here only for the entertainment and entertainment of the people. 

But some do not treat others like us and strongly believe in our prayers. I go to different houses and collect money from them once a week at every house, which is my earning way. I don't dance to earn. Three years ago, I went into a house, and they prayed for me that they didn't have it. In return, they will do anything I want. I prayed for him. When I went to his house a year later, Allah blessed him with twins. They are very happy and trying to give me some money. I refused to take the money and asked if I could do "Umrah." I didn't need the money. They agreed and made arrangements for me to visit Umrah.

Transgender Society is considered a symbol of shame in Pakistani culture. We are always faced with discriminatory behavior and the hateful attitude of fellow citizens. Society has no concept of jobs.

As a result, most of us have no other option to live our lives by singing and dancing on the street or in private parties. Additionally, transgenders are generally not encouraged to live in regular societies. We are obliged to establish our colonies outside the regular communities. There is no government assistance or support system to help us live a normal life. Government institutions and other governing bodies are known to harass the people of our community.

In case of any criminal harassment or sexual harassment, our members do not receive any help/support from the community or government agencies. When Society separates us, we have no choice but to be part of the eunuch's Society and to beg and dance throughout our lives. Parents need counseling if they can lead us to a better life. If they accept us, Society will change its attitude towards us. The government does not give us any rights, but I request that the government have the check and the balance that these rights are given to us. In the end, I want freedom from cruel mentors. The government should take action in this regard. Indeed, the government's efforts are not in vain until the media educates the public on issues affecting the transgender community".

· The status of transgenders

 

The first thing is we do not know about transgender. We do not know what transgender are? These days a few Transgenders are working in various fields and enjoying a better life, confusing why we are not accepting them. The reason maybe they don't like the same as us their appearance is different from us. We do not consider them normal Human beings.These discriminations do not allow us to accept them

In Pakistan, it is our common perception that transgenders (Hijras) don't have a bright future. In their future, they may only earn money by begging and dancing. But now I think the situation is being changed. A few of them are now highly educated as to the head of a transgender society who did M.Phil. From the University of Central Punjab Lahore and serving the transgender Society.So when it comes to the matter of their acceptance, we all should work for their acceptance. It's not one manpower show. We all consider and treat them just like a normal human being. In the early age of Pakistan's existence, women also faced discrimination, but gradually we accept them equal to men, and their status has changed. Similarly, we have to work for transgenders as a time would come when their discrimination will be demolished

As a person, I must say that the problem is not only of their acceptance but also of them, teasing them, and making them an object for humor. But it is more only because of them as they presented themselves in a manner that not considered normal. If they overcome things, the situation will be better soon. As they are perceived to be involved in sexual activities and many others, they must struggle for their rights and stand up for themselves.

Government and non-government organizations are working for their educational development. Now they are being enrolled in educational institutes, and CNIC are issued to them, and now they can be nominated for elections. So it may say that they are in a positive and developing way.

It is not mandatory for them to earn money only by dancing. But they beg and dance by their own will. They may do a job somewhere and establish a business. Now there are many NGOs working for their honorable way of working. 

Now it is not very tough for them to raise their voices. Many governmental and non-governmental platforms are there for their development. Many national and international platforms are supporting them. Media is the best way to raise their voice as loud as they want. Now trends are being changed transgenders are fighting for their rights as they are normal human beings and have emotions and feelings.

As a student, I must prefer separate institutes. Many people are criticizing their separate institutes. I favor, as it is very awkward for them to get an education at primary schools when they are older than the rest of the children. So, it is better for them to get early education separately and then get enrolled in colleges and universities. 

Recommendations

i. Our Society must accept them considering them a part of humankind while keeping the judgmental behavior and prejudice aside

ii. Transgender should work for their acceptance as well and refrain from activities that question their self-respect and status

iii. There should be separate institutes for them till high school, and vocational institutes should be opened to provide them the teachings of industrial work, so that they may play an important role for their country one way or the other.

iv. They should be recognized by the law as legitimate citizens of a country.

v. Shelter houses shall be built up to provide the necessities of life to those who are not accepted by their families.

vi. They must be given freedom of speech, expression, vote, and living.

vii. They should be provided with equal employment opportunities as other citizens.

Conclusion

In Pakistan, it is our common perception that transgenders (Hijras) don't have a bright future. In their future, they may only earn money by begging and dancing.
