One guy took MTN to court for unlawfully deducting #50 from his airtime in the name of unsolicited caller tunes he never suscribed to. An Abuja court found MTN guilty and ordered MTN to pay the guy 5M for disturbing his peace and another 500k for legal expenses.
According to the 1999 constitution of the federal republic of Nigeria as amended, If something infringes on/upon someone's rights or freedom, it takes away some of their rights or limits their freedom, these restrictions infringe upon basic human rights. The fundamental human rights contained in chapter 4 of the constitution of Nigeria are: the Right to Life, the Right to Dignity of Human Person, the Right to Personal Liberty, the Right to Fair Hearing, the Right to Private and Family Life, the Right to Freedom of Thought, Conscience and Religion, the Right to Freedom of Expression and the Press, the Rights to Peaceful Assembly and Association, the Right to Freedom of Movement, the Right to Freedom from Discrimination and then, the Right to Acquire and Own Immovable Property anywhere in Nigeria.
In regards to this MTN case, chapter 4 section 35 Right to Personal liberty of the 1999 constitution of the federal republic of Nigeria as amended , his liberty was striped off him to use the money in his account at will. Also MTN violated the NCC that is the Nigerian communications commission. The Nigerian Communications Commission is the independent National Regulatory Authority for the telecommunications industry in Nigeria in order to achieve its mandate, the Commission has put in place the necessary licensing and regulatory framework for the supply of telecommunications services. With this, the guy was able to sue for damages (Damages refers to the sum of money the law imposes for a breach of some duty or violation of some right it is intended to compensate the injured party for loss or injury, These damages are awarded to punish a wrongdoer and deter them from carrying out such actions again and also set example for others. The guy was able to recover all the money he spent in charging them to a court of law and made even more, lol. All he needed was concrete evidence and a good legal practitioner.
