In Islam, ‘fornication’ or ‘adultery’ and ‘rape’ are not one. Igtisab is used in Arabic to mean rape. It is as if we have taken the word 'Gina' to mean 'rape'. But that is not the case. This is why the crisis has been created. ‘Gina’ means that which is not a crime under our existing law, i.e. ‘intentional sex’, means sexual intercourse on the basis of consent. And ‘Igtisab’ or rape is forcible sexual intercourse with someone. Islam does not punish rape and adultery in the same way. Remember, fornication or adultery occurs only when one moves away from the practice of ‘morality’ in personal life. It spreads away from religion. And rape is a major crime, just as it is impossible for any society in the world to stop unjust killings. The issue cannot be underestimated by the people who commit such crimes. Jinnah's punishment is one hundred lashes if unmarried, and the death penalty if married. And in the case of rape, no such stratification has been done. Islam is seen as relatively flexible in the punishment of adultery, and Islam encourages secret correction from this practice. But in Islam, the rapist is seen as a ‘muharrib’, which is translated into English as “war against God and the state.” The state is obliged to ensure them maximum punishment i.e. ‘Capital Punishment’ as criminals in ‘Capital Crime’. The Qur'an determines their punishment, 1. The death penalty. Cut off the hands and feet 3. Emigration or transmigration. This time the state will determine the punishment according to the type and nature of the crime. So it is not a matter of judging what the woman's dress was or was not in the rape. Let's come now, does clothing really prevent rape? Islam does not say that only the veil prevents rape. Islam has rather provided the veil, because it reduces adultery, reduces the rate of rape. Naturally, rape is difficult, at least for people who are not criminals. But Islam not only tells women about this, but also tells men to guard their private parts and keep their eyes down. And tell the ruling party to ensure justice. Those who question women's attire for adultery or fornication, if they do not talk about men's vision, will understand that she has come to Islam in the guise of hypocrisy, to spread half-truths. Again, those who do not say that clothing is a reason for all this, those who think that there is no need for veil, want to introduce veillessness in the name of freedom of dress, they basically want to introduce adultery in the society.
