The Appellate Division of the Supreme Court has ruled that from now on, if the check is dishonored, it will not be punished even if it cannot prove any valid agreement regarding the transaction between the check giver and the recipient.

A full verdict was handed down by the Appellate Division headed by the Chief Justice on Wednesday (September 18th).

As a result of this judgment, the plaintiff will have to prove from now on whether the check issuer issued the check on the basis of consideration or consideration and the agreement has not failed due to which the plaintiff's debt to the defendant is valid.

It is known that if the check was dishonored before, in most cases the check giver would be punished. There was no obligation or direction to see if there was any reason for the check recipient to get the money at the check. From now on the check holder has to prove whether there was any valid transaction agreement between the check giver and the check holder. Whether he has fulfilled the terms of that contract. Only then will the check designer be punished.

A bench headed by the Chief Justice passed the order on February 18. Whose full copy is published.

As a result of this judgment of the Appellate Division, the check payers got a chance to prove their innocence. The verdict is also expected to reduce the suffering and harassment of candidates in check-related cases.
