At law, if a criminal suspect is not Mirandized prior to a custodial interrogation, his/her confession will be suppressed (inadmissible). Custodial: your freedom must have been encumbered (a reasonable person can't walk away). Interrogation: officers try to elicit adverse information (a voluntary confession is different).
