The Case To Remove The US Federal Government and Replace It With a Confederation Government

A few things first

First, I'd like to mention a few things before starting.

  1. I am not advocating for the Confederate South from the US Civil War. I am, however, in favor of a Confederation of States. Similar to how the United States was prior to the current Constitution with the Articles of Confederation.

  2. I do not condone violence. Only acceptable use of violence is if an individual has acted upon you and you need to fight for the preservation of life, liberty, and property.

  3. My post here is just a small collection of ideas, mostly incomplete. In no way should this be considered a complete, well formed system of governance.

The Federal Government

It is of my opinion that the Federal Government has become grossly power hungry and wants to centralized more and more power to the Federal Government. The Constitution is seen more as a piece of paper from a bygone era. Legislators have legislated themselves out of legislating. More and more power has gone to the Executive branch and departments.

A Few Ideas of What to Do

The Federal Government

Eliminate it. Completely dissolve the current US Federal Government. Remove all departments. Yes, including DoD, DoJ, and intelligence agencies. Eject all members of Congress.

The Constitution sounds pretty good but seems to have no way of dealing with situations, for example, when all branches have become corrupted. Yes, there is Article V in the Constitution to initiate a Convention of States but this doesn't seem to be working all too well. A Convention of States has never happened since the inception of the Constitution.

A Confederation Government

Any actions a Confederation Government can do will be listed in a Constitution. Anything not in that Constitution will only be left for the States to legislate if it does not violate the Confederation Constitution and State Constitution of that State. Any violation of that Confederation Government can be challenged by the State legislator of at least a simple majority of the States joined in the Confederation.

Any actions and rights not prescribed from the Constitution for the Confederation Government will be delegated to the member States of the Confederation of States.

The Confederation Constitution has a list of rights an individual cannot have suspended. This Confederation Constitution does not grant these right, but acknowledges that all individuals have these rights.

Any amendments to the Confederation Constitution must be proposed by the Confederation Congress and voted on by the State legislator. 3/4 of States that are joined in the Confederation must pass the proposed amendments.

Pay for Congress people in the Confederation Congress will be provided by the State that person represents.

A President will be in charge of the military. A president may engage in military action necessary for the defense of the Confederation. The Governors of each member State of the Confederation of States has 30 days to vote to declare war. War will be declared if the vote passes a 2/3 majority. If the those Governors do not declare war, the President must cease any military campaign relating to the vote of the those Governors.

Secession of a State

Any State that has joined the Confederation of States can, at any time, secede from the Confederation of States. Any State that secedes from the Confederation of States will not enjoy the benefits of the Confederation of States and will be treated as a foreign State.

But What About the CIA and NSA?

The CIA and NSA have become horrendously politicized as well as spying on its own citizens. A better solution to gather intelligence on belligerent foreign States would be decentralized agencies. Each State that is a member of the Confederation of States could house its own agencies. Those agencies will freely exchange information with other member States of the Confederation of States.

Information exchange with foreign States will be voted by the Confederation Congress and passed with a 2/3 majority. During war time, the power to share intelligence information will be delegated to the President.

Small government, at its essence, should exist solely to preserve life, liberty, and property. If so we have reached the point where it has become so cumbersome and authoritarian that it acts no longer in the best interests of the people it claims to represent, then we must return to states rights, and delegitimize broad consolidation of power, including promoting localized solutions, respecting broad individual liberties, and the dissolution of the Internal Revenue Service.
